Fairview Patient Charles Helmer - RE: Forced ECT procedures- Formal Complaint and Grievance - Notice to Cease and Desist

Patient Relations Department at Fairview Hospital,

I have written to both Mr. Helmer's doctor who is preforming these forced ECT procedures, Dr. Vine and also to the President and CEO of Fairview, Mr. Hereford regarding this young man’s treatment that is being forced upon him. What we want to know is how does this go on at your hospital and facility? How do you “allow” a Patient to be forced procedures “and” with life-threatening risks which include death as a side effect? When did Fairview Hospital whose motto has been "Heal More. Hurt Less" change? Your website states that “through teamwork and collaboration, we respectfully address the physical, emotional, cultural and spiritual needs of patients and their families.” There is nothing whatsoever that is respectful about forcing a patient treatment that he 1) Doesn’t deserve 2) He has not consented to.

There are Informed Consent Laws that protect Mr. Charles Helmer from this barbaric and unethically forced procedures. Reverting back to the Informed Consent “Law” it states that “Consent is given voluntarily and freely by the subject or his guardian or authorized representative “without” the intervention of force, fraud, deceit, duress, coercion or undue influence. The Committing Doctors have broken the law by preforming experimental procedures on Mr. Helmer. Experimental procedures that are harming his brain and body. Procedures that are unethically preformed without his consent to them.

Mr. Helmer has purposefully and repeatedly been Iatrogentically harmed because your Committing doctors felt that controlling this man’s own free will has been beneficial to him over all of the risks that he has faced to date and will risk in the near future and the future to come.

As a hospital, which is a place where patients seek help for their health concerns and consent to  treatments to help them get well, this patient has undergone the very contrary because of the committing Psychiatrists that work at your hospital facility. These forced procedures are barbaric and extremely detrimental to this young man, Mr. Helmer’s health. Patient safety should be the top priority at your hospital. Your hospital is on Violation because you have failed to protect this man’s Patient Rights and you have repeatedly assaulted his body. Assault on another person’s body is a punishable crime.

Fairview Hospital is in violation because they have failed to protect Mr. Helmer’s Human Rights and by breaking the law and not allowing him or his family to “choose” the appropriate treatments that are right and most beneficial for him in the long run. As mentioned in my original letter, the doctor’s who committed Mr. Helmer, told the courts that there were no other forms of treatment for him at this time. This is a blatant lie and is also unlawful to note and submit such falsified information to a US Court of Law. There are plenty of other non-invasive treatments that are evidenced- based to “heal” patients not force brain shock and damage to this young man’s brain. How do these procedures “heal” a young healthy man? How does this young man now succeed in society after this type of treatment that you deemed necessary to a court of law?

The hospital has continually violated his autonomy by forcing him to have procedures that he does not consent to receive. You have continually assaulted this young man's body and brain while repeatedly

re-traumatized him.

Autonomy definition: in Western Ethics and Political philosophy, the state or condition of self-governance, or leading one's life according to reasons, values, or desires that are authentically one's own. Charles Helmer has "Free Will” and NO man shall rob him of his Free and God-given wills.

Hospital Health Regulations which are set out and enforced by US Health and Human Services protect such fraud, assault and coercion and while also protecting Patient Safety, Welfare, and Human and Civil Rights. You have an obligation to protect Patient Safety which has been laid out by US Federal and State Law, and which you continually choose to violate.

We ask that you Cease and Desist these procedures immediately and that you not shock this man’s brain on April 23, 2021 or further Human Rights Violations with be sent to your hospital facility.
